Tasmanian Planning Scheme
Exhibition Notice - Invitation for Written Representations

The Burnie City Council in its capacity as a planning authority under the Land Use Planning and Approvals Act 1993 invites written representations in relation to the Burnie draft Local Provisions Schedule (BUR LPS) to be inserted in the Tasmanian Planning Scheme.

The Tasmanian Planning Commission (the Commission) has directed the planning authority to publicly exhibit the relevant exhibition documents in relation to the Burnie draft LPS under section 35B of the Land Use Planning and Approvals Act 1993 (the Act).

Representations must be related to the matters listed under section 35E of the Act, and are not be to the effect that the content of the State Planning Provisions (SPPs) should be altered.

The LPS must contain the site-specific qualifications and code-applying provisions currently within the Burnie Interim Planning Scheme that are required to be included in the draft LPS by reason of the transitional provisions of Schedule 6 of the Act. 

Any matter contained in a representation that addresses the content of the SPPs or that seeks to exclude any transitional provision will not be taken to be a representation.

The relevant exhibition documents in relation to the Burnie draft LPS and the relevant supporting documents, including the State Planning Provisions (SPPs) and a list of provisions required to transition from the Burnie Interim Planning Scheme, are available for viewing during normal business hours at the:

·       Burnie City Council offices at 80 Wilson Street, Burnie between 8.30 am and 5.00 pm Monday to Friday inclusive, excluding public holidays; and

·       Tasmanian Planning Commission’s offices at Level 3, 144 Macquarie Street, Hobart from 9 am until 5 pm, Monday to Friday, excluding public holidays.

The exhibition documents may also be viewed and downloaded from the Burnie City Council website at www.burnie.net, and the Commission website at www.planning.tas.gov.au 

Representations can be made in writing to the Burnie City Council from 21 October 2019 until close of business 20 December 2019.
